Warranty Policy

This Warranty Policy explains how product defects, warranty claims and after-sales issues are handled by Top Beds, operated by TOP BEDS BESPOKE LTD.

Any commercial warranty provided by Top Beds or a manufacturer is in addition to your statutory consumer rights and does not replace, restrict or reduce those rights.

2. Your Statutory Consumer Rights

Products supplied by Top Beds must comply with applicable UK consumer law, including the Consumer Rights Act 2015.

Goods must be:

  • of satisfactory quality;

  • fit for their normal purpose;

  • fit for any specific purpose made known to us where applicable;

  • as described; and

  • in conformity with the contract.

If goods do not meet these requirements, you may have statutory rights to remedies including:

  • rejection and refund;

  • repair;

  • replacement;

  • price reduction; or

  • a final right to reject.

The appropriate remedy will depend on the circumstances and applicable law.

3. Commercial Warranty

Where Top Beds provides an additional commercial warranty for a particular product, the specific:

  • warranty duration;

  • components covered;

  • exclusions;

  • conditions; and

  • remedy available

will be stated on the relevant:

  • product page;

  • order confirmation;

  • warranty document;

  • invoice; or

  • other written information supplied with the product.

If no specific commercial warranty period is stated for a product, this Warranty Policy does not create a fixed additional guarantee period.

Your statutory rights will continue to apply regardless.

4. Manufacturer Warranty

Certain mattresses, bed components, mechanisms or accessories may include a warranty supplied directly by their manufacturer.

Any manufacturer's warranty is additional to your legal rights against Top Beds as the retailer.

Where UK consumer law provides you with a remedy against Top Beds, we will not require you to deal exclusively with the manufacturer.

5. What May Be Covered

Where applicable under a specific commercial warranty, manufacturing defects may include issues such as:

  • structural frame failure caused by a manufacturing defect;

  • defective joints or fixings;

  • defective mechanisms;

  • defective storage components;

  • manufacturing defects in headboards;

  • manufacturing defects in upholstery;

  • material manufacturing defects;

  • defective workmanship;

  • manufacturing defects affecting the normal function of the product; or

  • other defects specifically covered by the written warranty supplied with your product.

Coverage will depend on the exact terms of the warranty applying to the product purchased.

6. Bed Frame and Structural Issues

Where covered by the applicable warranty or consumer law, structural issues may include manufacturing defects affecting:

  • frame construction;

  • supporting structures;

  • joints;

  • fixings;

  • legs;

  • bases; or

  • other structural components.

Normal movement, minor settling or reasonable wear from ordinary use will not necessarily constitute a manufacturing defect.

Each claim will be assessed according to:

  • the age of the product;

  • nature of the issue;

  • normal use;

  • product specification; and

  • applicable consumer rights.

7. Storage Beds and Ottoman Mechanisms

Where your product includes an ottoman lift, drawer or other storage mechanism, applicable warranty coverage may include manufacturing defects affecting:

  • lift mechanisms;

  • hinges;

  • gas struts;

  • supports;

  • drawer runners;

  • brackets; or

  • other mechanical components.

Warranty coverage does not normally extend to damage caused by:

  • overloading;

  • misuse;

  • forced operation;

  • incorrect assembly;

  • accidental damage;

  • unauthorised alteration; or

  • use contrary to instructions.

This does not affect your statutory rights where the component itself was defective when supplied.

8. Mattress Claims

Mattresses can naturally change during use.

Depending on their construction, normal characteristics may include:

  • initial softening;

  • settlement of fillings;

  • minor body impressions;

  • changes in comfort as materials settle; and

  • normal variation in surface appearance.

These characteristics do not necessarily indicate a manufacturing fault.

However, where sagging, structural failure or another issue amounts to a genuine defect, your statutory rights or applicable commercial warranty may apply.

Mattress claims may be assessed based on factors including:

  • mattress age;

  • mattress construction;

  • depth of indentation;

  • supporting bed base;

  • maintenance;

  • rotation requirements;

  • usage; and

  • manufacturer's specifications.

9. Suitable Bed Base

A mattress should be used on a suitable and appropriately supportive bed base.

Where a mattress has been used on:

  • a damaged base;

  • unsuitable slats;

  • excessively spaced slats;

  • an unsupported frame;

  • an incorrectly assembled base; or

  • another surface unsuitable for the mattress,

this may affect an additional commercial warranty where the unsuitable base caused the problem.

This does not remove statutory rights where the mattress itself was defective.

10. Natural Material and Fabric Variations

Products incorporating:

  • upholstery;

  • fabric;

  • timber;

  • foam;

  • stitching;

  • velvet;

  • woven textiles; or

  • other natural or manufactured materials

may show reasonable variations.

These may include minor differences in:

  • colour;

  • grain;

  • texture;

  • fabric direction;

  • shading;

  • stitching;

  • padding;

  • dimensions; or

  • surface appearance.

Colour may also appear different depending on:

  • screen settings;

  • room lighting;

  • photography; and

  • surrounding colours.

Whether a variation constitutes a defect will depend on:

  • the product description;

  • representations made before purchase;

  • the degree of variation;

  • reasonable consumer expectations; and

  • applicable consumer law.

11. Normal Wear and Tear

Subject to your statutory rights, commercial warranties normally do not cover ordinary wear and tear resulting from normal use.

Examples may include:

  • gradual fabric wear;

  • minor cosmetic marks;

  • expected material softening;

  • minor changes in upholstery tension;

  • ordinary fading;

  • minor mattress settlement;

  • reasonable signs of use; and

  • ageing consistent with the product's age and usage.

We will not classify a genuine manufacturing defect as normal wear and tear simply to avoid our legal obligations.

12. Matters Generally Not Covered by a Commercial Warranty

Subject to applicable consumer law and the specific warranty supplied with your product, commercial warranty coverage may exclude damage caused by:

  • accidental damage;

  • deliberate damage;

  • misuse;

  • neglect;

  • abnormal use;

  • commercial use where the product was sold for domestic use;

  • incorrect assembly by the customer or third party;

  • unauthorised repair;

  • unauthorised modification;

  • moving the product incorrectly;

  • dropping or dragging the product;

  • overloading;

  • incorrect storage;

  • water damage;

  • excessive moisture;

  • fire;

  • burns;

  • cuts;

  • stains;

  • pet damage;

  • infestation arising after delivery;

  • unsuitable cleaning products;

  • exposure to unsuitable environmental conditions;

  • failure to follow reasonable care instructions; or

  • damage caused by another person or product.

An exclusion under a commercial warranty does not remove any independent statutory right you may have.

13. Incorrect Assembly

Where assembly instructions are provided, products should be assembled according to those instructions.

Damage caused solely by incorrect customer or third-party assembly may not be covered by an additional commercial warranty.

Where assembly was carried out by Top Beds or a contractor acting on our behalf, this exclusion will not be used to avoid responsibility for defective assembly carried out by us.

14. Moving or Relocating Products

Beds and furniture should be moved carefully.

Large furniture should not normally be:

  • dragged across floors;

  • lifted by unsuitable components;

  • moved while fully loaded; or

  • forced through restricted spaces.

Damage caused after delivery solely by inappropriate moving or relocation may fall outside a commercial warranty.

15. Clearance, Display and Reduced Products

Products sold as:

  • clearance;

  • ex-display;

  • reduced because of cosmetic imperfections; or

  • otherwise sold with a disclosed defect

may have specific existing imperfections clearly identified before purchase.

A customer will not ordinarily be able to claim that a clearly disclosed characteristic is a new defect.

However, this does not remove rights relating to:

  • undisclosed faults;

  • misleading descriptions;

  • additional faults; or

  • other statutory requirements.

16. Making a Warranty or Fault Claim

If you believe your product has developed a fault, please contact us.

Provide as much of the following information as possible:

  • your full name;

  • order number;

  • delivery address;

  • product name;

  • date of purchase;

  • date the problem was first noticed;

  • clear explanation of the issue;

  • photographs of the whole product;

  • close-up photographs of the affected area;

  • photographs of relevant labels;

  • photographs of the supporting base where relevant; and

  • video footage where this helps demonstrate a mechanical problem.

17. Proof of Purchase

We may request reasonable evidence that the product was purchased from Top Beds.

This may include:

  • an order confirmation;

  • invoice;

  • receipt;

  • payment record; or

  • another reasonable proof of purchase.

18. Assessment of Claims

We may need to assess the product before deciding the appropriate remedy.

Depending on the problem, we may request:

  • additional photographs;

  • video evidence;

  • measurements;

  • product labels;

  • batch or serial information;

  • information about product use;

  • photographs of the supporting bed base; or

  • a physical inspection.

We will not impose unreasonable evidence requirements simply to obstruct a valid consumer claim.

19. Inspection

Where necessary, Top Beds, a manufacturer or an authorised representative may inspect the product.

An inspection may be required where:

  • photographs are insufficient;

  • the cause of damage is unclear;

  • a structural issue is alleged;

  • a mattress requires technical assessment; or

  • the appropriate remedy cannot reasonably be determined remotely.

We will arrange inspections reasonably and in accordance with applicable consumer law.

20. Do Not Dispose of the Product

If you make a warranty or statutory defect claim, please do not dispose of, destroy or materially alter the affected product before we have had a reasonable opportunity to investigate.

This helps us determine:

  • the nature of the problem;

  • cause of the defect;

  • appropriate repair;

  • replacement requirements; and

  • whether the issue falls under a warranty.

This requirement does not apply where keeping the product would create a genuine safety risk or where disposal is otherwise reasonably necessary.

21. Repairs

Where repair is the appropriate statutory or warranty remedy, we may:

  • repair the product;

  • arrange repair by a third party;

  • replace the affected component; or

  • arrange collection where required.

A statutory repair must be provided:

  • within a reasonable time;

  • without significant inconvenience; and

  • without charging costs that UK consumer law requires us to bear.

22. Replacement

Where replacement is appropriate, we may replace:

  • the defective part;

  • the affected component; or

  • the complete product,

depending on the circumstances and applicable legal rights.

If the exact model is no longer available under a commercial warranty, we may offer an equivalent replacement where reasonable.

This does not override any statutory remedy to which you are entitled.

23. Replacement Colours and Fabrics

Product ranges can change over time.

If a particular:

  • fabric;

  • colour;

  • finish;

  • model; or

  • component

is discontinued, an exact match may not always be available.

Where a warranty replacement is appropriate, we will discuss suitable available alternatives with you.

Your statutory rights will be respected when determining the appropriate remedy.

24. Refunds and Price Reductions

Where applicable consumer law gives you a right to:

  • a refund;

  • partial refund;

  • price reduction; or

  • final rejection,

we will process the appropriate remedy in accordance with those legal requirements.

An additional commercial warranty does not prevent you from exercising a statutory remedy where available.

25. Costs of Valid Claims

Where UK consumer law requires Top Beds to bear the costs of dealing with faulty goods, we will bear reasonable costs including, where applicable:

  • collection;

  • return;

  • repair;

  • replacement; and

  • re-delivery.

You should contact us before independently arranging expensive collection or repair services unless reasonably necessary.

26. Faults Within the First 30 Days

Where applicable, the Consumer Rights Act 2015 may give consumers a short-term right to reject non-conforming goods during the first 30 days.

The exact remedy depends on the circumstances.

Please contact us promptly if you believe goods supplied to you are faulty.

27. Faults Within the First Six Months

Where applicable, if a relevant fault appears during the first six months following delivery, consumer law may presume that it existed at the time the goods were supplied unless we can demonstrate otherwise.

The precise legal position depends on:

  • the nature of the product;

  • nature of the fault; and

  • circumstances of the claim.

28. Rights Beyond Six Months

Consumer rights may continue beyond six months and beyond any commercial warranty.

In England and Wales, certain contractual claims may potentially be brought for up to six years.

This does not mean that every product has a six-year warranty or must remain fault-free for six years.

Reasonable durability depends on factors including:

  • product type;

  • price;

  • description;

  • quality;

  • expected lifespan;

  • manner of use; and

  • maintenance.

29. Transfer of Commercial Warranty

Unless a product-specific warranty expressly states otherwise, any commercial Top Beds warranty is normally provided to the original purchaser.

Statutory rights are governed separately by applicable law.

30. No Effect on Statutory Rights

Nothing in this Warranty Policy is intended to:

  • exclude;

  • restrict;

  • replace; or

  • reduce

your rights under applicable UK consumer law.

If any provision in this policy conflicts with a mandatory consumer right, the mandatory legal right will prevail.
