Please read these Terms carefully before using our website or placing an order.

By using our website or purchasing from us, you agree to be bound by these Terms to the extent permitted by law.

Nothing in these Terms affects statutory consumer rights that cannot legally be excluded or restricted.

Shopify provides the e-commerce platform that enables us to display and sell our products online.

Shopify may provide functionality relating to:

Unless expressly stated otherwise, contracts for goods purchased through our store are entered into with TOP BEDS BESPOKE LTD, not Shopify.

9. Customer Responsibility for Access

Beds and furniture can be large and bulky.

Before ordering, customers should check:

  • front and rear entrances;

  • door widths;

  • hallways;

  • staircases;

  • turns in staircases;

  • lifts;

  • ceiling heights;

  • room dimensions;

  • parking restrictions; and

  • any other access limitations.

Customers should contact us before ordering if they believe access may be difficult.

Where a standard product is subject to statutory cancellation rights, an access problem does not automatically remove those rights.

Different rules may apply to genuinely made-to-specification products.

10. Bespoke and Personalised Products

Some Top Beds products may be genuinely manufactured according to individual customer specifications.

Examples may include products made according to genuinely individual:

  • dimensions;

  • non-standard specifications;

  • personalised design instructions; or

  • other unique requirements.

Under UK consumer law, certain genuinely made-to-specification or clearly personalised goods may be exempt from ordinary distance-selling change-of-mind cancellation rights.

However, simply choosing a product from standard options does not necessarily make it legally bespoke.

For example, selecting a:

  • standard size;

  • listed colour;

  • listed fabric;

  • listed headboard;

  • listed storage option; or

  • other standard configuration

does not automatically mean the legal cancellation exemption applies.

Where we rely on the bespoke goods exception, the product must genuinely meet the relevant legal requirements.

Nothing concerning bespoke products removes your rights where goods are:

  • faulty;

  • damaged;

  • misdescribed;

  • incorrectly manufactured; or

  • otherwise non-conforming.

11. Customer-Supplied Specifications

Where you place an order that is genuinely manufactured according to your own individual specification, you are responsible for carefully checking information supplied to us.

This may include:

  • dimensions;

  • names;

  • text;

  • colours;

  • materials;

  • configurations; or

  • other bespoke instructions.

Where we correctly manufacture a product according to inaccurate specifications supplied or approved by you, we will not ordinarily be responsible for problems caused solely by that customer error.

This does not limit our responsibility for:

  • our own errors;

  • manufacturing defects;

  • misdescription; or

  • other breaches of contract.

12. Prices

All prices on our website are displayed in pounds sterling unless stated otherwise.

The total amount payable will be displayed before you submit your order.

Where VAT applies, consumer prices will be displayed in accordance with applicable UK pricing requirements.

Any applicable:

  • delivery charges;

  • optional service charges; or

  • other mandatory charges

will be shown before you become bound by the order.

13. Pricing Errors

We take reasonable care to ensure prices are correct.

Occasionally, a genuine pricing or technical error may occur.

Where an obvious pricing error is identified before a binding contract has been formed, we may:

  • reject the order; and

  • invite you to place a new order at the correct price.

Where a binding contract has already been formed, our ability to cancel or amend it will depend on applicable contract and consumer law.

This clause does not give Top Beds an unrestricted right to cancel a binding order simply because we later wish to charge a higher price.

14. Promotions

  • promotional codes;

  • sale prices;

  • bundles;

  • free delivery offers; or

  • other promotional arrangements.

Promotions may be subject to conditions including:

  • start dates;

  • expiry dates;

  • eligible products;

  • minimum spend;

  • availability.

Any important conditions will be communicated with the promotion.

Unless stated otherwise, promotional codes:

  • cannot be exchanged for cash;

15. Placing an Order

Products placed in your shopping basket are not reserved merely because they have been added to the basket.

When you submit an order through our checkout, you make an offer to purchase the selected products.

We may send an automated acknowledgement confirming that your order has been received.

An order acknowledgement does not necessarily mean your order has been accepted.

16. Formation of Contract

A binding contract will arise when we accept your order in accordance with the information provided during checkout and applicable law.

Acceptance may occur when:

  • we expressly confirm acceptance;

  • production begins where this was clearly explained as the acceptance point;

  • goods are dispatched; or

  • another step specified during checkout constitutes acceptance.

17. Reasons We May Refuse an Order

If payment has already been taken for an order that we validly decline before contract formation, the amount paid will be refunded.

  • you are authorised to use the payment method; and

  • sufficient funds or credit are available.

19. Payment Security

Top Beds generally does not directly store complete payment-card details.

We reserve the right to delay or refuse an order before acceptance where legitimate fraud or security concerns arise.

20. Product Availability

Products are subject to availability.

If a product becomes unavailable after you place an order, we may contact you to:

  • offer an alternative;

  • agree a revised delivery period; or

  • cancel and refund the affected product.

We will not replace an ordered item with a materially different product without your agreement.

21. Delivery

Delivery arrangements are explained in our Shipping Policy.

Before you become bound by an online order, applicable delivery information will be provided concerning matters such as:

  • delivery charges;

  • delivery area; and

  • estimated or agreed delivery time.

Unless another delivery period has been agreed, applicable statutory delivery requirements will apply.

22. Estimated Delivery Dates

Unless we expressly agree that a specific date is guaranteed or essential to the contract, delivery dates communicated as estimates are not absolute guarantees.

We will make reasonable efforts to meet estimated delivery times.

Nothing in this clause limits statutory rights relating to delayed delivery.

23. Delivery Appointments

Large products may require a scheduled delivery.

Where applicable, we or our delivery partner may contact you to arrange or confirm delivery.

Customers must provide accurate:

  • telephone numbers;

  • email addresses; and

  • delivery information.

An adult should normally be available to accept delivery.

24. Failed Delivery

Where delivery cannot be completed because:

  • nobody is available at an agreed appointment;

  • the address supplied by the customer is materially incorrect;

  • reasonable access is unavailable; or

  • another customer-controlled issue prevents delivery,

a reasonable re-delivery charge may apply where properly disclosed or agreed and legally permitted.

We will not impose charges that conflict with statutory rights.

25. Risk During Delivery

For consumer purchases, responsibility for accidental loss or damage will normally remain with Top Beds until:

  • you take physical possession of the goods; or

  • another person nominated by you takes physical possession,

subject to applicable law.

Different rules may apply if you independently appoint a carrier not offered by us.

26. Title to Goods

Ownership of products will pass in accordance with the applicable contract and law.

Nothing in this section changes consumer rules concerning the point at which risk transfers.

27. Cancellation Rights

Consumers purchasing online may have statutory cancellation rights.

For eligible goods, you will normally have 14 days after receiving the goods to tell us that you wish to cancel.

Specific exceptions apply to certain categories of goods, including genuinely made-to-specification or clearly personalised products.

28. Returns

Where a statutory cancellation right applies, returns must be handled in accordance with applicable UK law and our Returns & Refunds Policy.

Because beds and mattresses are often large items, customers should contact us for return instructions before attempting to return them.

29. Faulty Goods

Nothing in these Terms restricts your rights regarding faulty or non-conforming goods.

Under UK consumer law, goods must generally be:

  • of satisfactory quality;

  • fit for purpose;

  • as described; and

  • in conformity with the contract.

Depending on the circumstances, remedies may include:

  • refund;

  • repair;

  • replacement;

  • price reduction; or

  • final rejection.

30. Short-Term Right to Reject

Where applicable under the Consumer Rights Act 2015, consumers may have a short-term right to reject faulty or otherwise non-conforming goods during the first 30 days.

Please contact us promptly if you believe your product is faulty.

31. Repairs and Replacements

Where repair or replacement is a statutory remedy, it must normally be provided:

Your statutory rights remain unaffected.

In particular, we do not exclude or limit liability for:

These Terms and consumer purchases from Top Beds are governed by the laws of England and Wales, subject to mandatory consumer rights that may apply in the part of the United Kingdom where you live.

55. Courts

If you are a consumer, nothing in these Terms prevents you from bringing proceedings in a court that applicable consumer law permits you to use.

Consumers resident in:

  • Scotland;

  • Northern Ireland; or

  • another relevant jurisdiction

retain any mandatory rights concerning jurisdiction that applicable law provides.

Nothing in these Terms is intended to:

  • limit;

  • restrict; or

  • replace

rights that you have under applicable UK consumer legislation.

Where a provision of these Terms conflicts with a mandatory statutory consumer right, the statutory right will prevail.
